ACCESS AND USERS

Access to the website www.skimountaincenter.com  confers the condition of USER on those who access it, expressing the USER’S full and unreserved acceptance of each one of these CONDITIONS OF USE.

The provision of the website service is free of charge. However, GRUP HIPER PAS reserves the right to make access to certain specific services conditional upon the prior registration of the USER by filling in the appropriate Newsletter Registration Form, which will be available to anyone wishing to register as a REGISTERED USER.

When it is necessary for the USER to register as a REGISTERED USER or to provide personal data in order to access any of the specific services, the provisions of the section on privacy policy shall apply to the collection and processing of USERS’ personal data.

The user undertakes to use the website and its services and contents without contravening current legislation, good faith, generally accepted uses and public order.

Likewise, it is forbidden to use the website for illicit or harmful purposes against the GRUP HIPER PAS, any of the companies in its Group or any third party, which, in any way, may cause damage or impede the normal operation of the website.

WEBSITE AND APPLICATION PRIVACY POLICY 

When using this Website, the Applications, and/or when communicating electronically with MERCA CENTER, SAU (hereinafter “ GRUP HIPER PAS “) through its web www.skimountaincenter.com; the personal data requested from the User are collected and processed. The data supplied by the User will be incorporated into an automated personal data file, owned by GRUP HIPER PAS, which will be processed in order to provide the services requested by the User. The user authorises the automated processing of the personal data supplied, necessary for the provision of the agreed services, which is governed by this privacy policy.

The personal information collected from registered customers is stored in a database owned by GRUP HIPER PAS, which assumes the technical, organisational and security measures that guarantee the confidentiality and integrity of the information in accordance with the provisions of Law LQPD 29/2021, of 28 October, on the protection of personal data, as well as the Regulation on the Protection of Personal Data RGPD UE-2016/679.

GRUP HIPER PAS, through its website, will use the data supplied by the User internally to inform the User of services, products and publications that it may consider of interest to him/her.

The user accepts that their personal data may be transferred to other companies of the GRUP HIPER PAS for the sole purpose of providing a better service, respecting, in all cases, Andorran legislation on the protection of personal data, and will not communicate this data to third parties, except when strictly necessary to manage and maintain the relationship with the GRUP HIPER PAS or with prior authorisation from the user in particular.

In any case, your data will be treated with a level of protection in accordance with the applicable regulations on Data Protection and will not be subject to automated decisions.

The legitimisation for the treatment is the legitimate interest of GRUP HIPER PAS in maintaining the existing relationship with the User and, where appropriate, their consent. Therefore, GRUP HIPER PAS collect and maintain your data as long as the relationship is in force and, where appropriate, the User does not revoke the consent given to the processing of their data. In any case, when the personal data is not necessary for the purpose for which it was collected and until it is definitively cancelled, it will be kept in blocked form.

INDUSTRIAL AND INTELLECTUAL PROPERTY

All the contents of the Website and Application, understood to include, but not limited to, the texts, brands, photographs, images, icons, links, as well as its graphic design and source codes (hereinafter, the “Contents”), are the intellectual property of the GRUP HIPER PAS or third parties, and none of the exploitation rights recognised by the current intellectual property regulations on the same may be understood to be ceded to the User, except those that are strictly necessary for the use of the Website and the Application.

The identifications, brands, names or distinctive signs are the property of the GRUP HIPER PAS or third parties, without it being understood that access to the Website and/or Application attributes any right over the aforementioned identifications, names and/or distinctive signs.

EXCLUSION OF LIABILITY

THE OWNER acts with the greatest possible diligence to ensure that the data and information offered on its website is always updated, although it does not guarantee and is not responsible for the accuracy and updating of the contents of the website, reserving the right to modify these contents at any time. THE OWNER shall also not be responsible for the information that can be obtained through links included on the website.

• The illicit, negligent, fraudulent use, contrary to these General Conditions, good faith, generally accepted uses or public order, of the website, its services or contents, by users.
